Amicus Briefs
CCDB accepts requests for participation as amicus curiae in cases and all requests are given consideration by the CCDB Amicus Committee.
The Amicus Subcommittee considers several factors in deciding whether CCDB should participate, including whether:
- participation in the case will advance the policy goals of the CCDB;
- the issues in the case have been adequately framed and appropriately preserved;
- an opinion issued in the case will have precedential value;
- a court has invited the CCDB to participate in the case as amicus curiae;
- certiorari has been granted, or a rule to show cause has been issued, in the case;
- an issue in the case is of substantial interest to the members or clients of members of the CCDB;
- other organizations will be participating in the case as amicus curiae;
- an experienced and respected appellate attorney is available to draft the amicus brief;
- there is sufficient time for the CCDB to prepare an amicus brief.
